On the 21st May 2021 Cabinet approved a report
of the Portfolio Holder for Business and Economic Growth seeking
approval to work with Essex County Council to submit a bid to the
Government’s ‘Levelling Up Fund’ (LUF). This
report authorised the following delegation: the Assistant Director
for Strategic Planning and Place can utilise funds already set
aside within the Council’s budget for Clacton Town Centre
projects and associated business case development to joint-fund any
necessary further technical work required in support of the
Levelling Up Fund bid. The responsibility for the LUF bids has
since transferred to Economic Growth team.
During September 2021 the Department for Levelling Up, Housing and
Communities (DHLUC) provided a £125k LUF Capacity Fund to all
Local Authorities in England most in need of levelling up
investment. This capacity funding was provided with the primary
intention of supporting the relevant local authorities to develop
their bids for later rounds of the Fund.
On 31st May 2022 Cabinet received a report requesting their
approval to submit two LUF bids in round two of the fund resulting
in the Economic Growth Team utilising £53k of the Capacity
Fund to secure consultants to strengthen the bid. These two bids
were successful with one being for Clacton and the other
Dovercourt/Harwich.
So that the projects have a dedicated resource to ensure that the
deliverables are met within the timeline set by DHLUC, recruitment
to a Fixed Term Capital Programme Assistant Director is required.
While recruitment commences an Interim Agency Capital Programme
Manager will be commissioned to ensure there remains the capacity
in the team to deliver the key priorities and projects currently on
the Council’s agenda.
On the 23rd March 2021 guidance was sought from Central Government,
that the remaining budget could be spent on mobilisation resource
to get the projects up and running. Confirmation has been received
that this is acceptable under the terms of the Capacity
Funding.
A competitive process has taken place in partnership with Essex
County Council to secure an Agency Capital Programme Manager.
Appropriate candidates were selected and interviewed and it is
proposed to offer an Interim Capital Programme Manager contract
through Vivid Resource for a temporary period to bridge the gap
until the Fixed Term Capital Programme Assistant Director is in
post to ensure the programme for delivery progresses.

without an EU public procurement tender procedure having been

The court held that EU procurement rules do not need to be complied
with by the contracting authority where the winning provider:
• Is controlled by the awarding authority/authorities in a
manner “similar to that which it exercises over its own
departments”, known as “structural control”

• Carries out the essential part of its activities “with
the controlling authority or authorities”, known as
“economic dependency”

The outcome of the Teckal case is now codified in the updated EU
Procurement Directives 2014 and applied in English Law under
PCR2015, incorporating some amendment and clarification as
follows:
1)A public contract awarded by a contracting authority to a legal
person* falls outside the scope of this Part where all of the
following conditions are fulfilled:—
(a) The contracting authority exercises over the legal person
concerned a control which is similar to that which it exercises
over its own departments;
(b) more than 80% of the activities of the controlled legal person

TDC Micro-grants (part of the Community
Champions Fund) to award the following organisation £500 to
contribute to the following:
iCARP work with groups of vulnerable young people and adults by
offering them the opportunity to experience group outdoor
activities, at our well-being centre, to help improve their mental
well-being. The activities and experiences we offer include
angling, bee keeping and rare breed chicken raising.
All iCARP birds currently are kept in roofed pens so that the
organisation adheres to DEFRA regulations around bird flu. On the
13/03/2023, in extremely high winds, they experienced high levels
of damage to pens and coops alike. This funding will contribute to
replacing and repair the pens and coops immediately or they may
have to lose the birds from site.
Subsidy Control and the new legislation (Subsidy Control Act 2022)
has been considered, including the four- limb test and it is not
considered that this project falls within the subsidy control
regime.
This funding will be underpinned with a funding agreement that
states they will be required to provide feedback on the impact that
the funding has had (which forms the monitoring of the
spend).

As part of continuing to provide financial support to businesses, the Government announced a mandatory Retail, Hospitality and Leisure business rates relief scheme for 2023/24.
Although a mandatory scheme, individual local billing authorities have to adopt a local scheme under section 47 of the LGFA 1988 to enable rate relief to be awarded to eligible businesses.

This follows the Cabinet decision on Friday
17th March 2023 to endorse Tendring District Council (TDC)’s
acceptance of £19.96m through the Levelling Up Fund (LUF) for
the Clacton Civic Quarter. The bid was developed in partnership
with Essex County Council (ECC).
To accept the funds, TDC needs to accept a Memorandum of
Understanding (MOU) provided by Government. The MOU is accepted via
Section 151 Officer sign off and acceptance must be returned to
Government by 28th March 2023.
In light of the timescale required for acceptance of the MOU, this
concurrence recommends acceptance of the allocation via signature
of the MOU but does not seek to secure approval on decisions on
specific spend.
