To appoint Porter PE to undertake a CIL
Viability Assessment on behalf of the Council.
To inform the production of the CIL Charging Schedule, and in
accordance with the CIL Regulations and the Planning Practice
Guidance (PPG), the Council requires consultancy support to produce
a CIL Viability Assessment to recommend appropriate CIL rates for
the District. The Assessment will identify CIL rates which will
maximise the potential for CIL revenue, while also ensuring that
the imposition of a CIL in the District does not render any type of
new development financially unviable.
Following the decision made on 17/09/2024 to being the process of
procuring a CIL viability assessment, a request for quotes was
undertaken resulting in the receipt of three bids.

Essex County Council has undertaken a public
consultation on its Local Nature Recovery Strategy between 30th
August 2024 and 25th October 2024. Introduced in the Environment
Act 2021, the Local Nature Recovery Strategy (LNRS) is a statutory
requirement and will be the primary strategic plan for tackling the
ecological emergency and reversing biodiversity declines within an
area.
Although TDC Officers have had an input into the formulation of the
Local Nature Recovery Strategy, Essex County Council are the
responsible authority and have progressed the LNRS to this stage in
accordance with the Environment Act. Officers from across TDC have
drafted a single coordinated response to the current consultation.
The Portfolio Holder with responsibility for Housing and Planning
has been briefed and consulted on this response.

Essex County Council has appointed Sport for
Confidence (SFC) to lead community partners in delivering
therapeutic interventions through physical activities. These
interventions aim to support adults with physical disabilities,
learning disabilities, long-term health conditions, and their
carers by promoting early help and preventative measures. The
council's initiative seeks to address health inequalities by
providing accessible, person-centred physical activity
opportunities.
Since 2019, SFC has operated at Clacton Leisure Centre, offering
sessions led by Occupational Therapists that include swimming and
bespoke classes. Participants are encouraged to overcome barriers
to exercise, whether due to mental health issues or physical
limitations. For some, even entering a venue and paying for an
activity is a significant step forward. Skilled Occupational
Therapists support participants in becoming more active and leading
fulfilling lives.
As part of the appointment, Tendring District Council (TDC) are
required to enter into a Service Level Agreement (SLA) to continue
its partnership.

Crystal Electronics Ltd was appointed to carry

replaced. Nonetheless, the contractor has kindly identified
additional savings through the introduction of 30 x PIRs in key
locations where LED panels are already present. The PIRs will
promote further savings by switching off lights when no movement is
detected in the area.
As such, a decision has been brought forward to amend the current

(e) notes the payment of £0.092m to East Suffolk District Council in-line with the previously agreed Freeport East Local Growth and Investment Strategy;
(f) notes the updated financial forecast, as set out in this report, and requests Officers, in consultation with Portfolio Holders to further develop the financial forecast proposals alongside the development of the Council’s priorities; and
(g) invites the views of the Resources and Services Overview and Scrutiny Committee on the information set out in this report along with the Council’s wider financial position as part of its work programme for the year.

1) notes the contents of this report which, amongst other things, explains the Council’s obligations around Biodiversity Net Gain (BNG), the role of Habitat Banks and the potential consideration of Council-owned land for BNG purposes;
2) agrees that proposed ‘Policy on Biodiversity Net Gain (BNG)’ (attached as Appendix 1 to the Portfolio Holder’s report (A.1)) is adopted as the Council’s interim corporate position pending the outcome of the Local Plan review, for the purposes of dealing with matters relating to BNG;
3) refers the aforementioned policy to the Planning Policy and Local Plan Committee for its consideration for inclusion in the Tendring District Local Plan as part of its current review;
4) invites the Planning Committee, at its earliest convenience, to consider and determine how it will exercise its power in respect of Council decisions on entering into legal agreements with landowners under Section 106 of the Town and Country Planning for the purposes of setting up Habitat Banks, guided by the aforementioned policy and the advice of Officers – including the extent to which the Committee deems it appropriate for such decision-making powers to be delegated to Officers; and any arrangements for public consultation on specific proposals; and
5) notes that the Portfolio Holder responsible for Housing and Planning in liaison with Officers will, in due course, consider and publish details of the fees to be charged to developers and landowners to cover the Council’s costs in respect of monitoring BNG in line with its statutory obligations.
