Minutes of the Last Meeting To confirm and sign as a correct record, the minutes of the last meeting of the Sub- Committee, held on
Minutes: It was moved by Councillor A Cossens, seconded by Councillor Smith and:-
RESOLVED that the minutes of the last meeting of the Sub-Committee, held on Monday, 9 February 2026 be approved as a correct record and be signed by the Chairman. |

Declarations of Interest Councillors are invited to declare any Disclosable Pecuniary Interests, Other Registerable Interests of Non-Registerable Interests, and the nature of it, in relation to any item on the agenda.
Minutes: Councillor Smith (Vice-Chairman of the Sub-Committee) declared for the public record that he was a London Taxi driver but that he had no ties in that capacity to the District of Tendring.
Later on in the meeting, as reported in Minute 36 below, Councillor J Henderson (Chairman) declared for the public record that she had received emails from the individual concerned but that she had not responded to those emails and that she had sent the emails to the Licensing Team. Councillor J Henderson stated that those emails had no bearing on the decision that would be made on this matter. |

Exclusion of Press and Public The Sub-Committee is requested to consider passing the following resolution:-
“That, under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during the consideration of Agenda Items 5 to 9, on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A, as amended, by the Act.” Minutes: It was moved by Councillor Davidson, seconded by Councillor Smith and:-
RESOLVED that under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during the consideration of Agenda Items 5 to 9 on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A, as amended, of the Act. |

Report of the Assistant Director (Corporate Policy & Support) - B.1 - Request to licence a wheelchair-accessible vehicle which does not meet the requirements under the Hackney Carriage and Private Hire Licensing Policy To consider a request to licence a wheelchair-accessible vehicle that falls outside the minimum seating-capacity standards required under the existing Hackney Carriage and Private Hire Licensing Policy. The Sub-Committee is invited to access the merits of the application, review any supporting evidence or justification provided by the applicant, and decide whether it is appropriate to depart from the policy in this instance in order to grant a licence. Minutes: RESOLVED that the individual’s request for a vehicle licence not be granted for a vehicle that fell outside the minimum seating-capacity standards required under the existing Hackney Carriage and Private Hire Licensing Policy and that the individual concerned be informed that they had the right to appeal the decision to the Magistrates Court within 21 days of the meeting being held. |

Report of the Assistant Director (Corporate Policy & Support) - B.2 - Application for the renewal of a Hackney Carriage/Private Hire Driver's Licence To consider a renewal of a Hackney Carriage/Private Hire Driver’s Licence where the applicants DVLA licence has been endorsed with 3 Penalty Points for exceeding the speed limit on a public road and review the subsequent decision made by the Licensing Manager. Minutes: It was RESOLVED that the Officers’ decision that the individual’s Hackney Carriage/Private Hire Driver Licence be endorsed with 6 Enforcement Penalty Points and be renewed for 2 years be confirmed. |

Deferment of B.4 - Request to Uphold Decision to Revoke Hackney Carriage/Private Hire Driver Licence Minutes: RESOLVED that this item be deferred to a future meeting of the Sub-Committee to enable the Licensing Team to further suspend the individual’s Hackney Carriage/Private Hire Driver Licence and to allow the item to come back to the Miscellaneous Licensing Sub-Committee for determination whether to revoke the licence. |
