Minutes of the Last Meeting To confirm and sign as a correct record, the minutes of the last meeting of the Sub- Committee, held on Monday, 17 November 2025. Minutes: It was moved by Councillor Davidson, seconded by Councillor A Cossens and:-
RESOLVED that the minutes of the last meeting of the Sub-Committee, held on Monday 17 November 2025 be approved as a correct record and be signed by the Chairman. |

Declarations of Interest Councillors are invited to declare any Disclosable Pecuniary Interests, Other Registerable Interests of Non-Registerable Interests, and the nature of it, in relation to any item on the agenda.
Minutes: Councillor Smith (the Vice-Chairman of the Committee) declared for the public record that he was a London Taxi driver but that he had no ties in that capacity to the District of Tendring.
In relation to agenda item 7, report B.2 – review of a Private Hire Vehicle Licence, Councillor J Henderson (the Chairman of the Committee) declared a Non-Registerable Interest in that she personally knew the wife of the licence holder. Councillor Henderson therefore informed the Sub-Committee that she would withdraw from the meeting at the appropriate juncture, and she would take no part in the consideration or determination of that item.

Exclusion of Press and Public The Sub-Committee is requested to consider passing the following resolution:-
“That, under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during the consideration of Agenda Items 5 to 7, on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A, as amended, by the Act.” Minutes: It was moved by Councillor Smith, seconded by Councillor Davidson and unanimously:-
RESOLVED that under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during the consideration of Agenda Items 5 to 7 on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A, as amended, of the Act. |

Report of the Assistant Director (Corporate Policy & Support) - B.1 - Application for the Renewal of a Hackney Carriage/Private Hire Driver's Licence To enable the Sub-Committee to consider a renewal of a Hackney Carriage/Private Hire Driver’s Licence where the applicant DVLA licence has been endorsed with 3 penalty points for exceeding the speed limit on a public road. Additional documents:
Minutes: RESOLVED that –
(a) the named individual’s Hackney Carriage/Private Hire Driver’s Licence be renewed for three years; and
(b) the Licensing and Registration Committee be requested to consider, at an appropriate juncture, amending delegated powers to enable Officers to fully determine those applications where the applicant has disclosed an offence that has resulted in penalty points being imposed on the applicant’s DVLA Driver’s Licence and they cannot provide information as to the speed being travelled at the time the offence was committed but where the number of penalty points imposed in accordance with DVLA guidelines would indicate that the speed was not excessively over the legal limit (i.e. less than 10mph).
The Chairman verbally firmly reminded the named individual of the need to comply with Condition 19 of the Hackney Carriage / Private Hire Driver’s Licence. |

Report of the Assistant Director (Corporate Policy & Support) - B.2 - Review of a Private Hire Vehicle Licence To enable the Sub-Committee to consider a review of a Private Hire Vehicle Licence where the licence holder has acquired 16 Enforcement Penalty Points. Additional documents:
Minutes: RESOLVED that –
(a) the named individual’s Private Hire Driver’s Licence be suspended for three weeks (subject to the statutory right to appeal to the Magistrates’ Court); and
(b) a formal warning letter be sent to the named individual setting out the potential actions and consequences that could be taken / occur if the named individual was to come before the Sub-Committee for like matters within the next three years.
