2.

To confirm and sign as a correct record, the minutes of the last meeting of the Sub- Committee, held on Friday 10 March 2023.

 

Minutes:

It was moved by Councillor Codling, seconded by Councillor Smith and:-

 

RESOLVED that the minutes of the last meeting of the Sub-Committee, held on Friday, 10 March 2023 were approved as a correct record and signed by the Chairman.

 

3.

Declarations of Interest

Councillors are invited to declare any Disclosable Pecuniary Interests or Personal Interest, and the nature of it, in relation to any item on the agenda.

 

Minutes:

Councillor Smith (Vice-Chairman) declared for the public record that he was a London Taxi driver of 33 years’ experience but that he had no ties in that capacity to the District of Tendring. 

 

Later on in the meeting, as reported in Minute 9 below, Councillor A Cossens declared an interest in relation to report B.4 – APPLICATION FOR THE REVIEW OF A HACKNEY CARRIAGE/PRIVATE HIRE DRIVER’S LICENCE insofar as she personally knew the applicant. Councillor A Cossens left the room when the report was put to the Sub-Committee and it was deliberated and decided upon.

 

4.

Exclusion of Press and Public

The Sub-Committee is requested to consider passing the following resolution:-

 

“That, under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during consideration of Agenda Items 5, 6, 7, 8 and 9 on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A, as amended, of the Act.”

It was moved by Councillor Davidson, seconded by Councillor Codling, and unanimously:-

 

RESOLVED that under Section 100A(4) of the Local Government Act 1972, the press and public be excluded from the meeting during consideration of Agenda Items 5, 6, 7, 8 and 9 on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A, as amended, of the Act.

Exempt Minutes

To confirm and sign as a correct record, the exempt minutes of the last meeting of the Sub-Committee, held on Friday 10 March 2023.

RESOLVED that the Exempt Minutes of the last meeting of the Sub-Committee, held on Friday, 10 March 2023, be approved as a correct record and be signed by the Chairman.

REPORT OF ASSISTANT DIRECTOR (GOVERNANCE & LEGAL) - B.1 - APPLICATION FOR THE RENEWAL OF A HACKNEY CARRIAGE/PRIVATE HIRE DRIVER'S LICENCE

To enable the Sub-Committee to consider an application for the renewal of a Hackney Carriage/Private Hire Driver’s Licence where the applicant has failed to disclose certain offence(s).

RESOLVED – that the named individual’s Hackney Carriage/Private Hire Driver’s Licence be renewed for two years.

REPORT OF ASSISTANT DIRECTOR (GOVERNANCE & LEGAL) - B.2 - APPLICATION FOR THE RENEWAL OF A HACKNEY CARRIAGE/PRIVATE HIRE DRIVER'S LICENCE

To enable the Sub-Committee to consider an application for the renewal of a Hackney Carriage/Private Hire Driver’s Licence where the applicant has failed to disclose certain offence(s).

RESOLVED – that the named individual’s Hackney Carriage/Private Hire Driver’s Licence be renewed for two years and the licence to be suspended until a satisfactory DBS has been received.

 

8.

REPORT OF ASSISTANT DIRECTOR (GOVERNANCE & LEGAL) - B.3 - APPLICATION FOR THE REVIEW OF A HACKNEY CARRIAGE/PRIVATE HIRE DRIVER'S LICENCE

To enable the Sub-Committee to consider an application for the review of a Hackney Carriage/Private Hire Driver’s Licence where the applicant has failed to submit documents relating to his Hackney Carriage/Private Hire Vehicle licence by their expiry dates on three separate occasions within the last 12 months in line with the warning protocol for Hackney Carriage/Private Hire Drivers, Vehicles and Operators.

Minutes:

RESOLVED – that the named individual can continue with his Hackney Carriage/Private Hire Driver’s Licence, however, if he comes back to the Sub-Committee again with late documentation, the Sub-Committee will consider a suspension of his licence.

 

9.

REPORT OF ASSISTANT DIRECTOR (GOVERNANCE & LEGAL) - B.4 - APPLICATION FOR THE REVIEW OF A HACKNEY CARRIAGE/PRIVATE HIRE DRIVER'S LICENCE

To enable the Sub-Committee to consider an application for the review of a Hackney Carriage/Private Hire Driver’s Licence where the applicant has failed to submit documents relating to their Hackney Carriage/Private Hire Vehicle licence by their expiry dates on three separate occasions within the last 12 months in line with the warning protocol for Hackney Carriage/Private Hire Drivers, Vehicles and Operators.

RESOLVED – that the named individual be allowed to continue but be requested to ensure that she is not late with the relevant documents when renewing the Hackney Carriage/Private Hire Vehicle Licence.
