Purpose:

The transfer of the affordable units/gifted units is subject to Schedule 2 of the Section 106 Agreement dated 20 July 2016 relating to land east of Halstead Road, Kirby Cross between Tendring District Council and Elizabeth Honor Clarke and Essex County Council which provides for affordable dwellings to be constructed in accordance with an Affordable Housing Plan which was to be agreed with the Council.

Decision:

(i) Acceptance of the transfer of the affordable/gifted units at Plots 196, 197, 208-214 (inclusive) at Finches Park, Kirby Cross also known as 64, 66, 68 and 70 Wheatsheaf, Kirby Cross and 12, 10, 8, 6 & 4 Spelt Close, Kirby Cross based on the recommendation of the Assistant Director of Planning.
(ii) Authorise the Assistant Director (Governance) to complete the transfer of the affordable/gifted units from the Developer.
(iii) Acquiring a shareholding in Finches Park (Frinton-on-Sea) Management Park Limited (Co. No. 11738949) with the official representative of the Council to be nominated by the Chief Executive.
