Decision details
Decision Maker: Corporate Director (Operations and Delivery)
Decision status: Recommendations Approved
Is Key decision?: No
Is subject to call in?: No
Purpose:
Harwich and Dovercourt Rugby Club has applied
for and been provisionally awarded Pitch Power funding by the
Football Foundation.
The grant funding is for a ten year period to carry out additional
pitch maintenance and improvement works at pitches owned by
Tendring District Council at Low Road Dovercourt.
Part of the grant award includes requirement for agreement of the
land owner in general, ongoing normal maintenance and, to allow the
club to carry out the works via a contractor. Provisions requiring
the Club to oversee risk assessments, quality and contractor
insurance are included.
The agreement doesn't provide for possession of land or for a
payment of consideration and is therefore, effectively, a licence
agreement.
Decision:
To complete a Site Owner and Site User Grass
Pitch Maintenance Agreement with Harwich and Dovercourt Rugby Cub
in order to allow the latter to accept and utilise grant funding
from the Football Foundation to carry out pitch improvement work at
Low Road, Dovercourt.
Alternative options considered:
Option 1 - Complete the proposed agreement -
proposed - allows external funding to be secured and pitch
improvements delivered.
Option 2 - Not complete the proposed agreement - not proposed -
would decline funding and improvements.
Option 3 - Seek to negotiate a different agreement - Not proposed -
the document is produced by Football Foundation as part of their
scheme. Normal provisions on risk assessment and insurance are
present. It is unlikely that any benefit would derive from an
attempted negotiation.
