In accordance with appendix A to the Property
Dealing Procedure.
To Licence the connection of the foul sewer
from adjoining development land to an existing adopted sewer in the
Council's land on standard conditions and in consideration of
undertakings to improve existing footways in the area of the
connection and to meet highway maintenance and adoption
costs.
Option 1 - Not agreeing the connection. Option
2 - Seeking a ransom value for the connection. Option 3 - Agreeing
licence terms for connection to be made. Options 1 and 2 were
discounted because of the potential for the developer to serve
notice on Anglian Water requiring them to provide a connection and
in turn Anglian Water's ability to compulsorily acquire rights.
Risk - the Licensee will indemnify the Council against any claim or
loss. Finance - The value of works to footways is likely to equate
to the amount that may have been payable in compensation under any
CPO procedure. Legal - S120 of the Local government act and case
law related requires that the Council manages its asses in the
interests of the area. Equality - No likely impact.
