Purpose:

Part 3, Schedule 3 - Responsibility for Executive Functions delegated to Officers 4.3 (1) the Corporate Director has delegated authority to discharge executive functions within their respective service areas (Part 3.38). All delegations are subject to consultation where considered appropriate in the circumstances (paragraph 4.3 (4 (ii) - Part 3.39). The Corporate Director , Corporate Services has delegated operational matters relating to the Council's JCC and union matters to the Head of People, Performance and Projects.

Decision:

The Trade Union Act 2016 requires from 10th March 2018 agreements to be in place to ensure that employers charge a reasonable fee for the deductions of subscriptions at source from the employer (DOCAS).

Alternative options considered:

Option 1 - Advice was taken from the Regional Employers in relation to the level of deduction and consideration was given to the current processes and systems in place within the authority to meet the requirements of the collection of UNISON subscriptions at source. Option 2 - The Council as an employer has a statutory duty to ensure that these is a DOCAS agreement in place by March 2018, in accordance with the requirement of the Trade Union Act 2016. Option 3 -None - this is a statutory requirement.
