Decision:

To grant a new lease of 40 Hilltop Crescent, Weeley pursuant to the Council’s statutory obligations to do so under the LEASEHOLD REFORM, HOUSING AND URBAN DEVELOPMENT ACT 1993 (LRHUDA 1993)and as no exemptions under that Act apply. 

 

Reasons for the decision:

To respond to a Notice served on the Council pursuant to Section 42 of the LRHUDA 1993as required by Section 45 of the LRHUDA 1993.

Alternative options considered:

Not to respond to the Notice and/or not to grant a new lease but this risks the leaseholderapplying  to the Court for an Order granting the new lease on the terms contained in the initial Notice and therefore a loss for the Council in terms of an increased premium for the new lease and increased legal costs in dealing with the application.
