The Portfolio for Housing notes the contents of the report on title and approves:

i) Acceptance to the transfer of gifted units - 5 Plots Asterwood, School Road also known as 1, 2, 3, 4 and 6 Oak Close, Elmstead Colchester based on the recommendation made by the Assistant Director of Planning.


ii) Authorise the Assistant Director of Governance to complete the transfer of the gifted units from the developer.

iii) Acquiring a shareholding in Asterwood School Road (Management Company) Limited (company number 14403988) with the official representative of the Council to be nominated by the Chief Executive.

Under Schedule 2 of the S106 Agreement dated 7 June 2017, 27 May 2020 and 4 August 2022 the Developer is required to transfer the 5 affordable/gifted units the Council at £1.00 per plot.

To decline the transfer of the affordable/gifted units is not an option. The acceptance of the gifted units forms part of the Council’s housing strategy to increase its housing stock
