Decision:

That the Portfolio Holder for the Environment having duly considered the outcome of the public consultation in respect of the proposal to implementation a Public Spaces Protection Order for the District of Tendring, as presented within the Officer report:-

(a)    Is satisfied on reasonable grounds that the activity or behaviour covered by the proposed PSPO is carried out, or likely to be carried out, in a public space:


has had, or is likely to have, a detrimental effect on the quality of life of those in the locality;


is, or is likely to be, persistent or continuing in nature;•is, or is likely to be, unreasonable; and


justifies the restrictions imposed.

(b)    agrees that the requirements of the Anti-social Behaviour, Crime and Policing Act 2014, the Human Rights Act 1998 and the Equalities Act 2010 have been followed in the preparation for and drafting of the Public Spaces Protection Order (PSPO) in respect of dog control and dog fouling;

 

(c)    agrees to the making, publishing and implementation of a Public Spaces Protection Order (PSPO) under section 59 of the Anti-Social Behaviour, Crime and Policing Act 2014 in respect of dog control and dog fouling, to be implemented in the Tendring District from August 2024; and

 

(d)    agrees to the proposed signage design and locations for the signage to be displayed, and authorises Officers to determine locations for further signage as deemed necessary once the PSPO is in force.

Reasons for the decision:

A decision is required in order to implement the proposed Public Spaces Protection Order.
